CCS collections is listed in my credit report against an outstanding debt.
How can I be sure that I owe the debt?
Can I get this item removed from my credit report if I pay off the amount in full?
Will my credit score improve if I pay it off and close the account?

Yes, the creditors or the collection agencies have only 30 days from the date of receipt of the debt validation letter to validate the debt or in other words the CA must prove within the period of 30 days that either they have purchased the debt from the original creditor or the original creditor has given them authorization to collect the debt. If they cannot validate the debt within this period, they CA would not be able to proceed further to collect the debt and at the same time cannot contact you further for the debt as per the fair debt collection practices Act. Moreover, the CA is required to remove the listing from your credit report. However, if the CA does not validate the debt and in spite of this do not remove it from your report, you can send a dispute letter to the bureaus asking them to remove the listing from the report.
Thats what I thought. Can they go back after not being able to validate and ask the OC for the proof and then validate or do they only have that 30 day period.
The collection agencies have only 30 days to validate the debt. Within this period, they may contact the original creditor for the proof. But what happens is that whenever the CA purchases the debt, they purchase them in bulk at a very low price (sometimes even less than 50% of the debt amount) from the OC without any papers and so most of them cannot validate the debt. However, if they cannot validate the debt, they need to remove the negative listing from your report.
Well at least this is good. It must be a oretty prosperous business because there are so many collection agencies out there.

I sent them debt validation and they still refused. These guys are not so nice, for the lack of a better word. I think a new system needs to be put in ther place.

Yes, I called them, it is a direct tv bill, this really irritates me because I sent back the recievers and they were supposed to send me a final bill and never did. I don't see how they could turn it over to collections if they did not send the final bill for me to pay. I am not going to pull a number out of the air to send them.

I recieved a credit collection letter in the mail today 10-01-08, regaurding the bill unpaid to Comcast Cable Communications, Inc. I am currently on Maternity leave from work untill November 1st.... being though I do not return to work untill the 1st, my first paycheck will not be recievd untill the 25th. I would like to arrange a payment plan of sorts, I have tried to contact your company by phone and was hung up on about three times... and everytime i attempted to call back i got a busy signal? If someone could get back to me I would be thankful.

In reference to the above file #, I am a bit confused as I received your notice on Friday, 10/03, and a bill from Mediacom on Saturday, 10/04, for the same bill, but $9.00 less. Isn't that kind of unethical for them to send me a bill after referring my account to you. Here is why I don't believe I owe them any money -- Our service was paid up to August 1, 2008; we had the service terminated on July 28, 2008 and hand carried the rented equipment to the local office the very same day. During our 6-month association with Mediacom, we had nothing but trouble and service complaints, the first being that upon installation, they did not connect our security service to the telephone line, so we were without security service for those entire 6 months; we kept calling, but they never responded. Then our DVR box stopped working on June 30th; it took a repairman until July 7th to come for that trouble call. He called his office to have them reboot the box which would take up to 90 minutes; he supposedly gave us his cell phone # to call in case the box didn't reset (which it didn't) and when we tried to call this #, it didn't work! We had to wait an additional 3 weeks for another service call! Then, they have the nerve to bill us 7 additional days after we turned in the equipment! They also charged us for 2 DVR boxes for the entire 6 months and we only had one! As I see it, Mediacom owes us money!

You should ask for pay for deletion only if you have not paid off the debt in full as yet. You can find a sample pay for deletion letter by visiting the link http://www.creditmagic.org/repair/pay-for-delete.html. However, if your creditor agrees to PFD, you should always get it in writing, because in case the creditor does not remove the negative listing from your credit report after you pay off the debt, this PFD agreement will help you to get the listing out of your report.

Since you have received the collection letter, I would suggest you first to send a DV letter by certified mail, to be sure that the CA you are paying actually owes your debt. The CA has to validate the debt within 30 days of receipt of your letter else you are not responsible to the CA for the debt. Now if they validate your debt, you should go for a repayment plan with the CA. You can try and make the CA agree to PFD also.

I am not able to get which debt are you talking about. If you are talking about the outstanding debts that are listed in your credit report, and you need to know the details of the debt, you should send DV letter to the creditors by certified mail. As per the FDCP Act, the creditor or the CA need to validate the debt within 30 days of receipt of your letter, else you are not responsible to repay them back and you can get the listing deleted from your credit report by sending dispute letters to the credit bureaus.
CCS Misrepresentation and Threats
I am curious. I have a private student loan and Kimberly Weld from CCS has contacted me several times. She has also contacted my mother's place of employment because she co-signed. I have made payments in the last few months. I missed this month, and although she has been told NUMEROUS times that my mom can't get personal calls at work, she continues to call. I am going to send a letter tomorrow, but I would like a fax number to send the STOP CALLING letter by fax as well. Also, what recourse do I have because she KEEPS harrassing my mom's job. She has told several people there ALL my mom's business! She called today and said she is going to garnish my mom's wages even though there is NO judgment, can they do that?
She has already violated the fair debt collection act and you should report her for this!!! Also if she was asked to quit calling your mothers work she once again violated these laws. You should really get this reported. I am unsure of a fax number but you should also fax along a copy of the fair debt collection act and outline in big yellow hightlighter all the ones she violated so far. you are not required to do this but I would anyway so everyone in her office can see how she is dealing with this.
I do want to fax them all of that, as I have already printed it all out AND highlighted it all. But there is NO fax number available anywhere and that furthers the fact that they are a shady company.

do not apply to collection agencies. Simply put most people in collections are there because they owe money. If you don't want calls from collection agencies paying your overdue bill is the best way to stop the calls.

Sometimes we ALL hit 'financial struggles' and if we could pay our overdue bills, RIGHT AWAY, I'm sure we would. We need a roof over our heads and food on the table FIRST..ya know?
Does this company really operate in so many places? How about the earlier question of how these places stay in business when they have so much fraud associated with their name? I wonder also how do they egt away with it? You would think if they were penalized more often then they would not be able to stay in business.
Many of the collection companies operate as franchises, and it's best to contact them to see which office they are operating out of if they call/mail you. They hide behind their multiple locations as a defense for not having responded to validation requests...

Is there many ways to keep this from happening? I would think that ifr you would call and ask for the information they may knowling give you the wrong info. What about the address on the envelope when they mail out collection letters?
Usually they will say that they sent that out from the mailing office, as was mentioned above they will say that they have many offices and that each of those offices have a different function.
So does this erve as a good defense for them? I guess what I am asking is if it would go to court and they never validated can they use this excuse to the judge and get away with it?
They won't fight, generally... As soon as they know you'll go after them, they'll just offer to "forget about the whole thing..."

I have one that is still lingering, this christmas will be two years since they served me with a summons, I swear that they thought I would just roll over and pay it. I sent debt validation and only recieved a copy of the bill the first time, second time a bogus affadavit, so I told them I would have this person subpeoned, or the affadavit is heresay. Any way, probably a year ago they said that it would go into arbitration, well I am still waiting to go to court.
Doc, how long can they drag this thing out before I can file something to get it all dismissed, hell criminals have a timeframe for speedy justice, shouldn't debtors.

Depends on the statute of limitations in your state... If they filed prior to the expiration of the SOL, they're fine. If there's a limitation in your state on how long they can keep it open without activity is something to ask the court clerk in the city/county where it's filed. Here, I believe it's about a year...
Credit collection services
I keep getting a recorded voice message from these people...looking for my adult daughter. They leave a "case number" but go thru the message so fast, you hardly have time to write anything down. If they are serious about collecting why don't they have a live person call so it can be discussed?
They probably have many cases that they are working on and know that if the person calls back then they have a chance at collecting. If you can let the message go to your voice mail then you will be able to get the number, call them back and tell them that they have the wrong number that she does not live there. I would not give them her number with out her permission, I would not want anyone giving them my information.

Collection Agencies
The fastest way to get a response from a collection agency when youv've been submitted to them in error is to file a complaint with the Attorney General's Office. I work for a collection agency and we put those high priority. It will push them to investigate and resolve the issue immediately.
Yes, if the collection agency do not respond to your DV request and still force you to repay back the debt, you can file a complaint against them to the FTC online. You can also also file a complaint against the bureaus with the FTC, if the bureaus do not remove any unvalidated negative listings from your report even after you send a dispute letter to the bureaus.
Apart from the bureaus you can also file a complaint with the BBB.

Someone got a credit card with my social # and this yahoo threatens me to pay this debt or else! I tried to explain it was not my card (which I don't have ANY credit cards) and that it was FRAUD. They continue to harass and now are calling family members. I am LIVID! What do I do?
Just fill up an online complaint form with the Federal Trade Commission. On filling up the form, you will get registered as an identity theft victim. Now file a complaint with the local police station with a copy of the online form, a copy of your identity proof and photograph. After filing the complaint, inform the creditor that you have been a victim of identity theft.
sunday credit collection phone calls
is there a law that says if a collection person calls a person on sunday to collect a debt, the debt is canceled and considered paid. need to find out if this is true for the state of florida.
A creditor or a collection agency can call you anytime if he has sufficient proof that you owe him the money. It is not illegal and the debt is not considered canceled or paid if he calls you up on Sunday or any other off day. However if you inform the CA that Sunday is inconvenient for you then they will put Sunday as a "no collection call day". If they call you on a "no collection call day", for the first time, it is not illegal, but a second call on such day is a violation of the Fair Debt Collection Practices Act.

I received a 2 recorded messages from this number in the last week and I became slightly concerned. So I checked my credit report and everything was fine. I then went on the Better Business Bureau (BBB) website to check this company out.... Its extremely sketchy, there are 4 different companies listed with very similar names and awful BBB ratings. Credit Collection Services (D+), Credit Collection Services (F), Credit Collection Services Group (F), Credit Collection Services aka CCS (F). I called the number (866-945-4977) back (on my unlisted/blocked work line) and Jessica answered. She asked for my file # and I asked her where she was located. She said Massachusetts. I then asked her how many locations they had and she said 3. One in Massachusetts and two in New Hampshire. On BBB web page they state that Credit Collection Service has THREE mailing addresses in Ma.

On the Credit Collection Services (D+) profile report they they list the most comprehensive contact info--but Steven Sands (the Principle) probably does not even exist. On the other companies they list Mr. David Freitag and Michele Meyer as the Principles. One would thing they could come up with better fake names then: Steven Stands, Michele Meyer, Mr. David Freitag -- Weak!

they are calling me and i am not the one with the dept. i got this phone number i quess the people before owe a dept . so i have to deal with the stupid dept company. i keep telling i am not her but they do not leave me alone. if u live in texas u do not have to put a collection agaent the money. because u do not owe them the dept is with the first company not ccs. they buy the loan for a pennies to a 100. yes u can get them takenoff your credit all u have to say i do not know this company i do not owe this dept to them. CCS and Farmers Scam
Last year 2008 I cancelled insurance on a motor cycle that I owned and no longer drove as it is a collectors bike and not on the street. I called Farmers and instructed the agent I was cancelling policy and was not going to renew. I received a bill for the continuation of the policy for another 6 months. I called the agent again to remind him that I cancelled the policy however he was out of town and spoke to a lady in the office and she said to call back the following week. I called twice and only recieved a voice mail message. I stated the policy number and I cancelled the policy and was waiting to hear from agent. A week passed so I called again as heard nothing back from the Farmers Ins agent. I left a message and stated I assume there is nothing more for me to do but do want a call back to confirm my messages have been received and the policy has been cancelled and I shoould not received a bill. I never heard anything back. About two months I received a collection notice from CCS for $30. I called the agent and spoke with a lady in the office who said the agent was not available. I explain to her I recieved a CCS statement for collection and wanted to speak to the agent. I received a call from the agent that it was a mistake and would take care of it. I stated getting harassing calls and more letters from CCS. The agent was no help. Since it was just $30 and CCS said they do not report to the credit buero I made a big mistake. I paid the $30 over the phone via credit card. Now CCS is fabricating bills owed stating policy numbers in another station under a different name. They claim I owe for fire insurance on my home. I have State Farm insurance and have had for about 20 years on all my homes and vechicles. I had Farmers Ins. on the Motor Cycle as when I bought it from the dealer they recommended Farmers as they had the best motor cycle ins. and the cheapest, all other insurance on Motor home, house nad al cars have been with State Farm. . They were the cheapest so I used Farmers. The purchase was in 2003 in Colorado and moved to Arizona in 2005 to retire. I have title to the motor cyle. So now I suspect my credit has been hit and in process of checking. I spent two days fighting this last scam from CCS. Farmers would not help said I need to deal with CCS and CCS said I needed to deal with Farmers Ins. Even though the policy number they claimed I own in May of 2009 is for a home in Indiana under a different name CCS said to pay up of suffer major credit problems. I finaliy reached an agent a Farmers that called CCS and told them there was no request for collection on the policy number and that it was not linked to me. I called CCS and they claimed I still owe the money. So I have been scammed and they are doing this to hundreds of people. and getting away with it through intimidation and calls all hours of the night. I always pay my bills and my credit rating was in the 800's. I fear now what they may have done to my rating. So now I am on the fight, I am seeking a lawyer that will take on the fight and sue Farmers Ins and CCS.

Though I have never dealt with Farmers Insurance company, I have heard that there has been a lot of complaints against them. Did Farmers Insurance company give you anything in writing, when you canceled your insurance policy? I think you should not have paid the $30, which you did not owe. You could have disputed the debt right away with CCS.
Now it is best to consult an attorney and file a lawsuit. Make sure that you get the negative remarks removed from your credit report, after the matter is settled.
