I had a car that was still fairly new, One year after buying it, I lost my job, and things got ugly. I fell behind on payments, etc. they came and repossed my car, as I knew they were. It showed up as a repo on credit report. 1 month later, they sold it at auction. It only had 6500 miles total on it, still like brand new.They Got a fair amount, but still said I owed them $5800, so reported it as a bad debt on credit report, they did erase the repo. But, the $5800 and price they sold car for, totaled adds up to much more than I was originally paying for car, I think all of that was interest I would have paid. So I am car-less now, and if I even had $5800 would buy myself a used car. I feel at this point top priority is get a car, so I can get back and forth to my new job. But they have sold to a collector and are harrassing me to no end.....I don't feel I owe for something I don't have. Now it shows up as a charge off on my report. And they are threatening me....

I received a written reply regarding my letter of dispute for a charge-off entry on my credit report.
Creditor states payments were 3 months past due which resulted in the loan being charged off.

Executive Analyst in writing acknowledges orginal payment due date was 1st of each month. In Jan 2008 payment due date was effectively changed to 15th of each month.

Also, letter states after thorough review payents for June, July & August 2011 were late. Account charged-off remains and will not be removed.

On September 7, 2011 creditor closed my account stating payments were past due and forwarded to collection for further collection efforts (collection agency same as creditor).

I have supporting documentation monthly payments made Feb thru June 2011 were paid by the 15th each month via auto draft.
July - paid on Sept. 10, 2011(57 days late)
Aug - paid on Sept. 19, 2011 (26 days late)
Sept 2011 through Jan 2012 - currently making on time monthly payments for remainder of $3,800.00 balance.

My question...

If supporting payment documentation validate dispute according to acknowledment of creditor letter -

Is disputing creditor for account charged-off status on Sept 7, 2011 valid and reversable?

THis would obviously look so much better on my CR if it showed late but paid in full, paid off instead of a charge off, payment after charge off/collection.
