A bill collector received my DV letter over 10 days ago and they have still not taken the account off my credit report. The account they are trying to collect on is for a corporation, but they put it on my personal credit report. What can I do to get some action? From my limited understanding it is a big no-no to put a collection account from a corporation on my personal credit report. Help!?!?
First of all they have 30 days to respond to the DV letter. Even then I normally have to send a 2nd letter in 4 days and occasionally a ITS letter after that.
Now, if you are asking if a LLcs debt can be placed on your personal credit, I dont believe it can. That is the entire point of creating the LLC seprate from your personal finances
As per the FCRA, the collection agency must validate your debt within 30 days of their receipt of the letter. If you have sent the debt validation letter under certified mail, sent the proof to the credit bureaus along with the dispute letter telling them that you do not agree with the listing in the credit report.
They can not place a debt for a corportaion on your account. There was another post here a long while back and it was a fairly good runnung thread that listed corporations could not list on your report. I would definately check into this. You really do need to wait the 30 days and then start disputing. Some collection agency that can not validate a debt will not bother and so you can have them removed.
