My wife has a loan out with a company called Cash Call and another one with ThinkCash, plus numerous payday loans. I was unaware of these loans until she suffered a mental breakdown and they then came to light. I am working towards getting her to file Chapter 13 Bankruptcy. But until we get this done, I was wondering what steps I should anticipate Cash Call taking. At this point they are just blowing up her cell phone since she is not allowed to take calls. Any ideas on what their next step will be if they do not get their calls answered. She is about 4 months in arrears on paying all of the loans mentioned above.
well
first what state are you in,and was the cashcall loan originated by western sky?if so then the loan was not only illegal, but ws/cc/delbert are getting taken down by at least two dozen states.so please answer what state, and was the cc loan orignated by western sky.we can help you here.
If you're sure about filing bankruptcy, you can take the step as after you file for bankruptcy, the court imposes "automatic stay" that will bar all collectors and creditors from carrying on with their collection efforts.
Cash Call is a licensed lender. But if it has originated with Western Sky, then it’s illegal in this case. Illegal lenders can’t take any legal action against you. If Cash Call hasn’t originated with Western Sky, then it’s considered as legal lender. In this case Cash Call can sue your wife because of nonpayment of debt. So try to find out their legality first and take steps accordingly. If they are licensed, then you are liable to pay them both the principal and interest. In this case negotiate with your lenders and set up a payment arrangement with them.
