Can they take me to small claims court?

I got a payday loan in Alabama about 5 months ago for $400. paid it off, then got another and another, then our house cought fire and we lost everything. I wasnt able to pay back the last payday loan I took out. They call me constantly saying they are going to take me to small claims court and get for fraud because its been 5 months and I closed out the bank account I used already. I do want to pay this loan but money is hard right now. I need a little time and they don't want to give me anymore. My question is can they take me to small claims court? How long does that take? Do I have time then to get this paid off? Can they get me for fraud when i closed that account?

well since fraud is a crime,and non payment on a pdl is not a crime.so who is the lender?even a storefront can't do that.they talk out of both sides of their mouths.small claims court is civil court,and fraud is criminal.so was this an internet lender?if so report them.i'm guessing it is as a storefront would work with and understand.an internet is most like;y illegal,and i wouldn't worry about the illegal threats.get back on your feet,and i'm soory about the loss.

What are the names of the pdl companies? Are your lenders licensed in your state? If yes, then they can file a lawsuit against you. But if your lenders are illegal, then they won’t be able to take any legal action against you.

No, they can't get you for fraud as non-payment of payday loans is not a crime.
