I have just received a Wage Garnishment in California from the Courts for and outstanding credit card that was from 8-9 years ago.

I have been working hard with others credit card companies to settle most recent outstanding accounts to clean up past credit issues and reestablishing my credit.

I thought they cannot persue me, if accounts are beyond a certain time period in California? (7 years?) I had just recently paid in full for another account with this same company just last year, and now is garnishing me for the second account.

They have not sent me notices, and/or I had not received any because of moving, however I've been employed with same company for last 6 years.... why now? Can I still call them to make arrangements for payment and/or too late?

Hello LCT,

Credit card debt consolidation can be a resource to consolidate the outstanding balance on your cards. However in California the SOL is 2 yrs for the oral contract, 4 years for written contract, 4 years for promissory notes and open ended accounts.

So I don't think that you are still entitled to pay the money. Therefore let them know that according to the SOL of your state you need not pay the money any more. Let them know that you are aware of this.

Hope this helps.

Thanks.
