Hello all,
I need help! I was recently delivered a court summons for a claim from the hospital. Although I have insurance, the claim is still pending due to a "previous condition". I have been in contact the insurance company and have been faxing them the requested documentation. I have finally gotten some kind of movemnet but now I have this court summons that I must submit to the court either denying or admitting the claim. Obviously I admit to the claim, but I just need help explaining this in writing! Please help!

Hi Luckyton,
Along with the summons, you should've gotten a copy of a document called complaint, and you may have received some other papers as well. Read the petition filed against you carefully and note the date and time that the summons orders you to appear in court.
Respond to the summons within the time frame allowed answering the issues addressed in the summons - that you admit to the claim. With it submit any documentation supporting your answer as attachments.
Ensure that your response letter contains a case caption at the top. Have the letter notarized (verified and signed by a notary public) to be considered valid and official. Copy the signed notarized response letter and retain the copy for yourself. Submit the original response letter to the clerk of the civil court where the original complaint is filed. Then make notice of your answer to the plaintiff that you've answered to the summons.
Thanks

only a fool would admit to a claim, make them prove it.
