I want to know what the current information is for responding to a summons for civil court regarding credit card debt. My identity was stolen, and this company wouldn't listen to what I was telling them. Chase collections, and finally sold my account or information to some other company, and they sold it to another place. Actually, the account or debt was sold to 3 different places before the last one (MSW Capital) decided to file for civil action. Evidently this company filed or tried to file in Aug but never got the summons to me. I have the original filing paper, a copy of the first summons, and an alias summons in civil action in the pack of papers I have in front of me. These papers were mailed in the regular US mail - not certified, and they were mailed to my original address, then were resent to my present address. The first summons states that I have been named defendant or third party defendant in a complaint or third party complaint filed ... The second is the alias summons stating I'm the defendant in a complaint filed. The rest of the papers are exhibit documents - bill of sales and assignment (exhibits A1-7 in all). None of these sale receipts specifically state my account number or name. All they basically have on them are how many accounts and how much the total sum for the purchase of those accounts were at the time of purchase. 1 page, exhibit B1, Is a copy of a page from my Chase account that shows the total amount due, the due date, finance charges, etc ... And page 2 exhibit B2 is just a partial copy of Chase's agreement for the CC. It has no signature on it - it's just a generic copy. On the top of that page, there is a section of the agreement that you fill out for a change of address.
I have to run up to the court house next week (Mon or Tues - time's up Oct 7), so I need to know exactly what to write in my response to the summons itself. I need the current information for this type of response. Can some of you help please? Thanks ....
Complaint filed, been summonsed, need specific info

ok thanks Sally!
Is that information in the page that you posted current this year? I'm asking because I heard some rules changed this past year regarding how to respond to a summons and what we can do about the plantiffs. It is just here say - that's why I'm asking here.
