Need help on how to respond to foreclosure summons

Submitted by godd2 on Thu, 01/14/2010 - 17:32

My wife and I have fallen behind on our house payments. We just got a summons for foreclosure. We are to respond to that letter within 20 days. I am not sure how to do that. we are behind 4000 dollars and i have that money to pay now. I am currently speaking with the mortgage lender to find out what needs to be done. do i simply explain that in my letter?

On a side note, does anyone have any idea how much in legal costs and fees extra it will be besides the outstanding payments? i am worried about that.

...and it seems as though they want a leg too!

Let me start off by stating that i have already gone thru a bankruptcy in March of 2004 stemming from my inability to pay off years of CC debt. Well I sure did learn a lesson regarding the use of CCs, & since the BR I've done just fine with one card ~ that being my financial institutions own credit/debit card that is linked directly to my account. Everything is dandy these days on that end ... however:

Proper Debt Validation?

Submitted by Donkc_29 on Thu, 01/07/2010 - 08:44

I have read alot of good advice in this forum and I am in need of some myself. I had a car loan 3 years back and I lost my job. I had to turn the car in because I was no longer able to afford it. Well a collection agency picked up the tab but I never responded to them. Almost 3 years later I get a summons that I'm being sued for this debt by the collection agency's attorney. I went to the courthouse and filled out an answer form denying the debt and then I sent a request for a debt validation letter to this attorney.

Getting Behind

Submitted by zackrat on Wed, 01/06/2010 - 17:12

I recently got behind on a bill that I have been paying on for years, the balance has not went down, it is high intrest. I would like to have the intrest lowered but don't see that happening because of my credt score being low. I am getting frustrated because they are now calling me daily, this is the first time that I have gotten behind because of some unforeseen expenses, I plan to catch it up when I get my income tax but in the mean time they keep calling.

Auto Loan Charge Off

Submitted by Chargered_Off on Fri, 01/01/2010 - 22:18

We have an auto loan that was charged off on 12/15. I told them that my husband had just started a new job, and a very good one at that, and would be able to catch the loan up to current status on the 18th, but they would not put a hold on the charge off. I now have the money to pay, but they won't accept anything less than the full amount of the loan. We are still in possession of the car, and are really not willing to give it up. I've told them that we will pay off the loan in full this year, a full 4 years early, if they would just allow us to make payments again. Still no go.

Hey guys.

I owe American Express money but the account went into collections over the summer. Now a law firm is trying to get me to pay... I sent them a validation request and they responded with a summons yesterday along with exhibit A: the terms of the card agreement (my signature or name not on it) and B: a copy of the latest card statement with my name and address and balance, and an "affidavit in support of sworn account" that's notarized stating that all "facts stated herein are true and correct." by an affiant "attorney in fact".

Solutions.  Does the company only offer one debt relief solution ? Or are they well-versed in a number of options? Having a variety of choices means they can find the right debt relief program that fits your specific needs.
•  Cost.  How does the debt relief company get paid? The best ones will earn their money from a percentage of what they save you; that way, they only get paid if you save money.
