Hi,
I would just want to know something about judgment. Can we dispute a judgment or can we file a motion to vacate judgment if we weren't served properly.
This is on my husband's CR and he doesn't remember ever being served. The judgment is 4 years old. We will be visiting the court house tomorrow. So, I would like to know what steps we are to take. Can we directly go on to file a motion to vacate the judgment?
I appreciate any advice.

You can file a motion to vacate the judgment if not properly served. If you have not been properly served, you can vacate the judgment.

Before you can file the motion to vacate the judgment try to make sure that your husband had not been served. You can then directly go on to file the motion. However, here nobody's an attorney. I think it is always better to consult an attorney in regards to court cases.

Most recorded judgments will remain on your credit file for 10 years. And, after 10 years, the judgment can be renewed - indefinitely if the creditor elects to renew the judgment every 10 years
