in nevada, how do you get back garnished wages within the 90 day period of filing bankruptcy? do you have to take another step? does the attorney usually handle this automatically? or does the money go to creditors & not the debtor??

As far as I know once taken, money will not get returned by the creditor or colelction agency. However, if the money was garnished after the bankruptcy was issued, then you may get the money back.

However, there is another way in which you may get back the money. For that the garnishment will have to be over $600, garnished by the same creditor, and the garnishment will have to be done within the past 90 days. The attorney is required to return it on the request of the trustee. However, if the money is not returned, a counter lawsuit may be filed. For this, you can consult a bankruptcy attorney.
