Hi I am new to posting here but have read a lot of the wonderful posts here. I had a bad debt from a charge off from household finance company in 2002. Midland bought the debt and it is still showing on my credit report even though the oc has been long gone off the report. The problem is I don't know exactly when it fell off or the date of first delinquency happened. I know it was in 2002 but I have no proof of it other then that the original creditor is no longer on my report.
There are not any judgments on my report and I have never received a summons. The statue of limitations in Pa is 4 years. I was just wondering in your expertise what is the best way to proceed. Just fight it based off the 7 year clause or should I actually go the long route and try to get them to validate the debt? Thanks in advance to anyone who replies.

Don't you have receipt of your last payment made? Can you tell what the colelction agency is reporting? Whether or not the Statute of Limitations on this debt has expired, depends on when the last payment was made. However, you can still try to validate this debt. Send the letter through certified mail, requesting a return receipt.

2. write a letter to midland asking for all records of the debt. who is the original creditor and when was the contract made.
what household finance company is this?
"www.hfc.com" is the original creditor. The contract was taken out in 99 and defaulted in late 2002 early 2003. I have since moved and have lived at my current house for 6 years same state, Pa. I made a lot of bad choices but I did my time in the bad credit zone. I just wasn't sure how to proceed. i just wish I had the old credit reports from when it first went late but I lost that paperwork when I moved six years ago.

stop worrying about the records. Midland is required to send them when you DV.
I would file a complaint about this debt with your AG and the Federal Reserve. State that they have changed the dates on this debt and refuse to send records.
I sen the dv letter today cmrrr so I will keep you posted.
Return slip received. A day later I got another dunning letter from Midland from a different office. This is not proper validation. I have also found the original statements from exactly when this account went belly up. It is past the 7 year time out limit. I will send a follow up DV letter to Midland and that after that I will be sending letters to the CRA's.
