Help! I dont know what to do! Almost 2 years ago, my husband and I moved out of an apartment is St. Louis, MO, and we went to pay our final balance to the apartment manager. We thought we owed them about $800. The office told us that we did not owe them any money, and in fact it looked like we were going to get a refund of our security deposit for almost $1000. They assured us that this was the facts, but we did not get it in writing from them. After that, we drove across the country and moved to Alaska. This cost us a lot of money, and we were tapped out when we got up here, not to mention that my husband opened up his own business, and I am a stay at home mom. We got a letter a few months later that the apartments had made a mistake and we actually owed them almost $1200. We told them that we no longer had the money to pay this. We had it when we went to their office, but since they assured us we didn't owe anything the money was spent. We are on an extremely tight budget and don't have the money to pay them. They have sent us to collections, and now the collection agency is wanting to send us to their attorney and to have them sue us. Can anyone tell me what my rights are? It is only in my name, not my husbands, and I don't have a job, or any income. If they got a judgment against me, could they take money out of my bank account? Also what happens since I am in Alaska, and this all happened in Missouri?

I agree with cinnamngrl. You should send a "debt validation letter" to the collection agency. You will get a sample validation letter at http://www.creditmagic.org/repair/sampleletter-debtvalidation.html .
However, if they wins a judgment against you people, they can take money out of your bank accounts.

Yes this is probably your best course but if they validate you will still have to come up with a repayment plan. You can take this step by step and first send out the debt validation letter by certified mail.
