Judgment dispute or vacate

As far as I understand, there are 2 options on judgments, if we don't agree to a judgment. We can either dispute the judgment with the CRA or we can file a motion to vacate judgment if we weren't served properly.

The judgment is on my husband's credit report, and he doesn't remember ever being served. However, the judgment is 5 years old. What can we do? Should we dismiss the judgment or file a motion to vacate the judgment?

Thanks

Hi Nysa,

If you dispute a judgment, the judgment will go away, but the debt won't. As a result, you may have to face more problems. Thus, it is better to vacate the judgment. First, visit the court where the judgment was filed and check the details of the judgment. If the notice on the judgment was not properly served, if your husband didn't sign or receive any notice, you people can file a motion to vacate the judgment.

Hope this helps.

Regards,

Aaron
