I continue to recieve calls on my cell phone from Vital Recovery Services, Inc. They call me several times a day on my cell phone. I am not even the person they are looking for. I have tried to tell them I am not that person. I got this number a few mo. ago. I have called them and tried to tell them to take my number off their records. I have been ill and they call my cell phone about every 15 min. I talked with them three times. They continue to call. I fianlly called my attorney. I had to get an address for my attorney and finally found it this eve. I will have my attorney file harrassment charges against them should they continue to call me.
What is the Fair Debt Collection Act 15:1692 ? What is the FDCPA section 809 (b)?
Thanks for any information you can provide.

This service calls me daily...8:00 a.m. to 8:00.p.m. I am not who they are looking for this has to stop. I am engaging the FCC to intervene. This company is the most screwed up operation I have ever encountered. :?: :!: :twisted:

As per FDCPA section 809(B), if the consumer notifies the creditor within 30 days that the debt is disputed, and the debtor asks for the name and other details of the OC, the CA must cease collection of the debt, until they produce any document verifying the debt or any copy of a judgment.

Now if you are not the person they are searching, you can lodge a complaint with the FTC and the AGs office that they are harassing you for no reason. I think this will help you get out of the situation.

i am not the person ( james t. harding ) they are looking for I got this cell phone number 7 mounths ago 5 mounths ago vital recovery services inc. keeps call my cell phone i called them three times to tell this not the person they are looking for. they keep calling, and now i am getting more and more calls from them. i now am recieving up to 5 calls a day. please stop them

Sounds like you are dealing with a lot of what I did in the past with someone elses creditors calling and annoying you. I know just how stressful this can be and really feel for you. I imagine they think we are the actual person they are trying to reach and we are just lying. I followed the advice I got here on the forum. It really worked...for a while..then they would sell this persons debt and it would start all over again. My best advice is after you send validation letters or contact the FTC (all of which I did) your next best move is getting caller ID on your cell phone and not picking up their calls. Good Luck

You are probably in the computers dailing system, it will continue to call until they either pulll you from it's list for call them directly and let them knwo, either valdate or quit calling me.

I tell you I think that system is the biggest pain in the rear end to people who owe money and I think that is part of the design, if you are on the dailer, you really need to pay attention to the Fair Credit Collection laws, make sure their machines are following the laws just as they expect a real person to.

What I think is really the most irritating is they actually don't have to sit there and listen to the phone ringing. Do you ever notice there is a period of silence once you pick it up and then a couple clicks. Man they got this down to an art.

You can DL phone tray dialup (free) if you're on dialup or phonetrayfree for DSL/broadband if you're on high speed. I use phonetray free to ZAP callers automatically. Works great as long as the PC is on. If they change phone numbers just add the new number & set to zap after 1 ring, i love it, they hate it

I forgot to mention, you need a dialup modem in your PC connected to your phone line to use phonetray, phone tray will work if it see's your modem. You also need caller id.

I received a notice from Vitall Recovery Services Inc, indicating that I had an outstanding debt with Ford Moor Company. The letter was sent in my maiden name and I don't own a Ford product. After contacting them, they explained that I had a Ford Tracer, in which I told them I did not. After going back and forth with them, they asked for my last for digits of my Soc. Sec. #. Then I was told, 'Oh, then this isn't your's'. I asked how did they get my address? She told me that they do Skip Tracing. My question is how can you do Skip Tracing without all the right information? Are they only going by a name? Something has to be done about this.

These guys ran a hard credit inquiry on me today. I have had no letters or any calls. I do not owe anyone anything. Is it legal run credit checks without authorization? I have lived at this same address for years and years.

If you have applied for any new line of credit like a credit card or a loan, the creditor will pull down a credit report and a hard inquiry will be listed in your report which will stay there for two years. However, sometimes the marketing people randomly checks your credit report and if they find a good report they offer various financial services at low rates like credit card services and personal loans. Now since these inquiries are unauthorized they can easily be removed from your credit report.

Only authorized hard inquiries can stay in your credit report as per the fair debt collection practices Act. Now if you find any unauthorized hard inquiry in your credit report, all you need to do is to send letters to the inquirers whose name you find listed in your credit report asking them to verify your authorization or remove the listing. You may also threaten them that you will complain to the State Banking Commission if they do not remove the unauthorized listing. The inquirers generally remove the listing because they cannot verify your authorization. But if the hard inquiry has been authorized by you, the listing will stay in your report for two years.

No, conducting a hard inquiry is not legal without your authorization and if it gets reflected in your credit report, you can ask the inquirers to get it out from your credit report as Justin said. If you do not get it removed immediately, your credit score may drop down and it would take some time again to recover this credit score. So do not ever neglect an unauthorized hard inquiry and get it removed from your credit report as soon as possible.

I am glad Mary explained this in detail. I was not aware of it taking a little time for your score to readjust. I had assumed once you disputed it and it was removed that they would put your score back where it was.

They are calling me on a debt that is over 10 years old and I paid off when I re-fied my house. I have bought a car since then and this never showed up. They legally cannot call on a debt that is over 10 years old so I have been told. When I call them back they said their answering machine is full. Whazzz up with these people and where did they get this old information?

my wife owned a car that was rear ended and considered a loss. This happened in 2003 I have never received a bill or a collection notice until Vital called my home mar 23rd 09 and harrassed me to pay $4100.00 but would settle for 16 hundred. I offered them $800.00 and the refused threatening me. Today the called and agreeded to settle for $800.00 and I refused to pay them at all and I was threatened again. Is there a statue of limitations on old debts. Who are these people. Why has it taken years to request money. The original company charged off the debt years ago. Do they have a right to demand money and threaten me. What recourse do I have.

Yes, you should first check the Statute of Limitation on the debt before you make any payment towards the debt. If the last payment was made in 2003, then by now the SOL may have expired. SOL on debt varies from 3 years to 10 years depending upon the state where you have signed the loan agreement. If you can tell us the state where you have obtained the loan, I can try to help you out in this forum.

Call us two times a day, even though this debt was accured by ex-wife and put an ad in paper disclaiming all debt from her..............it is about 15 years old and they still call.

Vital Recovery Services is trying to collect a debt after it was referred to them by GMAC. The funds were paid to GMAC 20 months ago and this is the THIRD FRIEKIN' COLLECTION agency I am dealing with. I told them last week that it was paid and the manager assured me that they would not contact me again. Guess who called today? I'm not a happy camper and will calling the AG's office in Arizona as well as the President of GM ( no wait- Thats President Obama isn't it?) to complain and get an address to send the process server to deliver the class action lawsuit I am about to get started.

have been receiving calls from VRS in error--calls intended for another person. I suggest that everyone receiving mistaken calls from them starts reversing the tables and calling the company as often as possible. If enough people do this they will have some financial impact having to pay personnel to deal with the calls. If there is a financial impact, they may start to deal with the problem!

I was getting solicitation calls from the same place/person and he wouldn't stop. In fact when I told him to stop, he said 'no.' When he called the next time (within a few minutes) and my caller ID let me know it was him, as soon as he said something, I blew a life guard whistle into the phone mouthpiece. He didn't call again.

Could you please get this company to stop calling me? They call me about a room mate of mine who moved out years ago, if she has debts I am not responsible for them. I have filed a complaint with the FCC and I am hoping that they get thru to this company to stop calling me all the time. I pay what I owe and do what I need to do in my life, tell this company to stop calling me for Donna Frazier, she no longer lives at my address and I have no way to contact her.

Hi Marge,

If they continue calling you, you can first explain them that the debt isn't yours, and you do not have any contact information or address of your friend. Thus, ask them to stop calling you. If they don't comply. You can tell them that they are under violation of Fair Debt Collection Practices Act (FDCPA), and so you can sue them.

They have been calling our car phone for several weeks. I tried calling them back during their "normal business" hours. They are constantly closed. They never leave a message. We have had this phone for 5 years. it is illegal in this state to try to collect on a debt after 4 years so their actions are illegal. Even if s omeone connected to this Trust owed them money.

Received one today saying I owe them over $5000 for an account in 2006. Also, it refers Wells Fargo as the creditor. Funny thing is I was living in another state where there are no Wells Fargo banks and never had a car loan with Wells Fargo. I think this is a scam. This place never show up on credit report so I'm not worried but I will call them and see how they explain this account.
