I'm retired Civil Service receiving an annuity that is not enough to meet my monthly expenses due to the rising cost of living. If I stop payment on my credit card can a credit card company garnish or attach a payment to my Civil Service Annuity?

i owe $2,000 on a student loan. it is 35 years old. i was sued for the money (now at $7,000. with interest) i am retiring in three months can the law firm garnish my retirement ? they had a garnishment order for my pay at work, but i told them i would pay cash if they wouldn't garnash my wages, now they refuse to talk to me when i call for the payoff. so when i retire can they still go in and garnashment my retirement money?

Hi,

Can you tell the date of first delinquency? This debt may have passed the Statute of Limitations (SOL). SOL is the time limit within which a debtor may be able to sue you for non payment of the dues. It starts from the date of first delinquency.

However, generally speaking retirement cannot be garnished. Still, you can check the garnishment laws in your state on retirement.

Thanks,

Aaron

Can my civil service retirement annuity be garnished for a student loan. I was old and sick when I went to school; age and disability discrimination out there is brutal in the job market. Help! I can't find a job and I only get enough retirement to pay my rent and buy food.

Hi Shirley,

Generally, civil service retirement annuity or benefits cannot be garnished. However, rules vary according to the states. The garnishment will also depend on the type of debt. If it is a government debt then federal benefits can get garnished.

You can try debt settlement. Debt settlement lowers the outstanding debt amount by 40-60%.

Thanks,

Aaron

If an employer pays a garnashee order after a bankruptcy number has been provided, are they liable to pay the money back to the employee?

my car was impounded when a friend drove without valid license.
I couldn't pay for release,so it was sold. The bank wasn't interested in buying it, but now are after me for remainder of $900 left on
contract. I have only soc. security and pension and made some small payments for awhile but found I couldn't continue. Can they attach my pension or what is my best action?

I took a pay out on part of my civil service annuity but now I can't pay the monthly bill due to life circumstances. What will happen to me? Can they garnish my civil service annuity?
