Behind on my mortgage

Hi,

I am 3 months behind on my mortgage. So, to help myself i have enrolled into a counseling service and I have a counseling session with NACA on Saturday to find out if there is anything I can do.

I want to save my home but if I can't how long do I have before I am required to move out? I live in South Carolina but really don't understand the Foreclosure law. Will I be notified that I have 30 days to leave the property?

However, I have been getting a letter stating I had 45 days to catch up the loan for some months now. I make a payment, and again when I miss it, they send another one the next month but this month I sent the payment and it bounced. I am in a mess :(

Yes, you will be notified of the eviction process. However, whether you will have 30 days or more will depend on the state laws, and the time taken to foreclose the property. It may vary from case to case.

Check the status of this account on your credit report. Accordingly talk to the mortgage company about your payments.

I would suggest that you speak with a Foreclosure or Bankruptcy attorney about your situation. You want to make sure you are aware of all of your options to ensure that you have all the necessary tools to act to save your house. Most attorneys will provide you with a free consultation so that you can learn if they have any options available that can assist you to keep your house.

Last year I was terribly behind on my mortgage and could not catch up. It seemed impossible. I was in the process looking for rent houses when my mortgage company called to ask if I would be interested in loan modification. Please call your mortgage company to ask about this option. It can cut your mortgage in half and forgive most of your past due debt or refinance it into your mortgage. You can also go to hopenow.com for more information. What happens if your mortgage company uses this program is you will need to provide your income information and information on the bills you have. They will lower your mortgage to a new affordable rate with an interest rate as low as 2% for I believe its the first 3 years then the interest gradually goes back up until it gets to 4 or 5%. If you prequalify they will put you on trail payments you can not be late for 3 months if you are even a day late they can deny the modification and you will be foreclosed. This is a government program designed to help you keep your home. There are other options such as a DURefi call a bank and ask about this. They refinance your home to help you get a lower payment and you don't have to have good credit. I think you qualify as long as you are no more than 60 days late. Also if you continue you to make a payment every other month depending on your state they can't foreclose unless you are more than 60 days late. Why don't you try refinancing your home mortgage loan? The interest rates are pretty low now! Go and get some quotes from multiple lenders before knowing the foreclosure law. Work to avoid foreclosure.
