I lost my job a few months back do to know fault of my own. When that happened I could no longer pay the minimum on my credit card and eventually it went to a collection agency. I spoke to them and offered to pay $20-30 per month because that was all I could afford do to being on the verge of losing my house, car etc. That said that wasn't good enough. I then received a letter saying that I was being sued and I would be served a summons soon. I feaked out! Well I was in my backyard one day a man came and asked if I was or knew ( my name here) and I said no because I knew what it was. I haven't seen him since then. My question is will they keep trying to serve me or is there an expiration date on the summons? Also can they garnish my unemployment? Please any info appreciated I am so scared

Hi deedee,

Welcome to this community :)

Summons do expire. However, the party trying to serve you may request a re-issue of the summons. The collection agnecy will go on trying to serve you. Moreover they do not need to serve you in person. They can simply leave it at your door. If you still do not answer to the summons, the collection agnecy will win a default judgment against you. Thus, it is better to answer to the summons.

Also can they garnish my unemployment?

No, unemployment benefits are non-garnishable. However, you have home and car, and the collection agency may put a lien on those through the judgment. You won't be able to sell any of those till you pay off the debt. I think you should try to get a part time job deedee.

Thanks,

Aaron
