Hey all,
New to the forum and have a question. I sent a DV letter to an original creditor about 2 weeks ago. And we got a letter back with absolutely no information in it that we requested.
I would like to mail them back and tell them that the "30 day clock" is still ticking, and if they don't give me the information I had requested, I am going to request that the CRAs remove the information. I believe that's the order it's supposed to be done in - not quite sure as I'm new to all this.
What part of the FDCPA can I quote to them to remind them that they have 30 days to respond to my validation request? Or can I quote FDCPA?
However, I have read somewhere that there is no "30 day clock", they can take as long as they want. It was also mentioned that if you give them 30 days to validate, they will have to validate it within those 30 days.
Thanks in advance.
Debt validation request
Hi Ava,

You cannot send debt validation letters to the original creditor. Debt validation letters are generally send to the collection agency.
What part of the FDCPA can I quote to them to remind them that they have 30 days to respond to my validation request? Or can I quote FDCPA?
You can't quote Fair Debt Collections Practices Act (FDCPA) because it does not mention that the debt needs to be validated within 30 days. The FDCPA rather mentions that the debtor is required to send validation letters within 30 days of the first collection attempt.
It was also mentioned that if you give them 30 days to validate, they will have to validate it within those 30 days.
I don't know if there is any rule regarding this. However, generally people say so.
Thanks,
Aaron
