I have two retirement pensions PERS--a survivor lifetime pension and STRS--a disability lifetime retirement pension. I can have them mailed to me, rather than depositing them in a bank, but my understanding is than both institutions must abide by a court order for garnishme t. I have also been told to check an exemption box if I did receive a court notice of a garnishment procedure. HOWEVER IS A CALIFORNIA RETIREMENT PENSION EXEMPT FROM THIS TYPE OF GARNISHMENT ?. I understand that in most states it is protected.

Hi kcrox,

Welcome to this community :)

Generally retirement pensions cannot be garnished as per Federal Law. In California 401K and other retirement income is non garnishable. However, it is better to deposit the retirement income in a separate bank, and separate account.

Thanks,

Aaron
