I have 2 questions.
1- I have noticed some folks on here mention that a CA has 30 days to validate debt. But then ive seen where some have said there is no limitation on the time a CA has to validate debt. Which is correct?
2- 6 months ago i sent a DV Leter to Palisades Collection Agency. They sent me a letter in return saying they were ceasing collection activities on the account and that they would eventually validate the debt...as i say that was 6 months ago and i have heard nothing. Last week i noticed that Palisades had stopped reporting the item on my credit report. Do they have to stop reporting on something they are trying to validate?
Thanks in advance!!
validation time limits
Hi foreverandever,
1- I have noticed some folks on here mention that a CA has 30 days to validate debt. But then ive seen where some have said there is no limitation on the time a CA has to validate debt. Which is correct?
The second one is correct. That is there is no fixed time limit within which the collection agency will have to validate the debt.
As for your second query, did they send any other letter on the validation?
Thanks,
Aaron
Hi Aaron,
Thanks a bunch for your replies.
There has been no more letters from palisades since their answer to my DV letter. I just wonder if their not reporting the item on my credit report is their way of saying they are washing their hands of it...i doubt i could be so lucky though.
validation
Hi,
I think you are lucky :) Wait for a few days, and see what happens. Also keep the letter they sent as proof, so that you can use that to solve problems that may arise later regarding this account.
Thanks,
Aaron
reporting an item on your credit report is a collection activity (according to the federal appeals court) So it is illegal for them to keep reporting while you are waiting for validation.
debt validation
Hi cinnamngrl,
I just wanted to know. Does the collection agency remove the item during the validation process?
Thanks,
Aaron
during validation they will mark it in dispute but if you receive nothing from the CA then you have a good argument to use a MOV letter to force it off your report
