I have gotten notices in the mail that I may be getting a judgement put against me if I do not contact them regarding my credit card account. I want to contact them however I want more information on my legal rights.
I currently get disability and may be unable to repay what the seek for. I already filed bankruptsy before this happened.
Can this creditor still take legal action on garnishing my income when the only income I have is my disability?

Income which constitutes a part of social security benefit cannot be garnished. If you have already filed a bankruptcy, I think you need not worry as no legal action can be taken against you. However bankruptcy will remain in your credit report for 10 years and you may find it difficult of getting credit.
The best thing that you can do for yourself is sit down and read into the state and federal guidelines that creditors are legally obligated to follow. You will want to research your states statute of limitations, and various debt cllections laws IMO, everyone should read into the FCRA.
Also, you might want to look in to the DC. Sometimes when you google them you find out all sorts of tidbits like, they have oodles of lawsuits against them for FCRA violations. :lol:
I too agree with CMBV22 on this point. One should always go through the SOL of your state and FCRA before going for a credit.
Have you validated this debt? They legally cannot file suit against you until they validate your debt if you requested it. Also, is this the first you have heard from this debt collector?

I received a judgement letter. I'm already under the credit settlement program. what should I do. I don't have money to spare. please help.
Send a debt validation letter to whoever sent you the judgement letter. Send it certified mail and return reciept requested.

A judgement letter is a letter telling you that they intend on suing you and giving you time to either make payment in full or be sued.
Sometimes they use this as a scare tactics, is it the original creditor or a collection agency.
Just a little interested in that one cause I see Midland around here alot and I have an account that just pasted SOL last Dec. Figured they had to serve me before they could land a judgement but I moved since then and there isn't even a home on the lot where I use to live.
Someitmes you see posts that people find judgements against them and weren't even aware they were there. I was just wondering how they could not know they were there if they had to be served and fo to court before one could be placed on them.

You need not worry about the judgment because social security cannot be garnished to recover credit card debts. However, if you receive any summon you should file a response to it and inform the court that the money that gets credited in your account is your ss benefit. Social security benefit can only be garnished to recover alimony and child support obligations and Federal Tax debts.

I have a friend that has just been put on SSD and has received judgment notice prior to receiving notice of the Disability settlement with the SSA. Can a judgment be levied against this friends SSD income?

Can I know what this judgment is about? Disability cannot be garnished as per the Federal Law. However, if this debt is any way related to tax, or alimony, or child support then the judgment may get levied against your friend.
