how can a credit card company obtain a judgement against you when the card is unsecured? we live in PA, my father is 82 years old gets Social Security benefits, he was recently hospitalized, he now need a caregiver and blood work done every week and cannot pay his credit card bills. He received a letter stating that his account will be forwarded to an attorney to obtain a judgement against him. My name is also on the deed to his home, can a judgement be placed against his home?
If you have outstanding debts on your credit cards for over six months it is considered delinquent and the creditor can sue you to the court to recover the debt. However, if the debt is past SOL, then even if the creditor sue you, they can never recover the debt.
Now, if the creditor sue you to the court, he can bring a judgment against you either to garnish your wage or your bank account. However, social security benefit can never be garnished to recover the credit card debt. I don't think that judgment can be placed against his home to recover the debt.

This will depend on various kinds of things. If the judgment was on any jointly owned account, ten the other person will be responsible for satisfying the judgment. In case of singly held account, this will depend on your assets.
