My mother recently received a summons for a judgement to response in the state of California. She only gets Social security benefits. Should she respond or ignore it if she can't pay. What date does court go by if it 30 days from the date she was served and stamped June 14th and just got it? If so which forms does she need to complete?

Hi mungi,

Welcome to this community :)

She should answer to the summons, else the creditor can win a default judgment against your mother.

What date does court go by if it 30 days from the date she was served and stamped June 14th and just got it?

The time starts from the day after which the debtor was served with the summons. For more details refer What Is The Time Frame To Respond? part from http://www.lawhelp.org/documents/273941C-5%20Filing%20an%20Answer.pdf?s… .

As for

If so which forms does she need to complete?

The form to answer to the summons generally remains attached to the summons itself. If not, you can get the answer form either from the Internet, or from the court clerk. You can also request the court clerk to help you in framing the answer to the summons.

Thanks,

Aaron
