Discover card got a default judgement against me in 2004 while living in Washington state. Later that same year I moved to Pennsylvania and that is where I currently reside. I just looked at my credit report today and it states that the "Estimated date that this item will be removed is 3/2011". What does this mean? Can they still come after me? I have not had wage garnishment, etc. What should I do? I want to move on from this and I don't know how to go about it. Is there an SOL that will finally end the judgement?
I don't have court records or anything.
default judgment
Hi ItIsMe,
As the debt was incurred in Washington, and the judgment was issued in Washington, the Statute of Limitations (SOL) on judgment of Washington will apply. The SOL on judgments in Washington is 10 years. So, the judgment is still valid.
As for
"Estimated date that this item will be removed is 3/2011"
The judgment is a negative item entered on your credit report. All negative items fall off your credit report after 7 years. Thus, as it was entered in 2004, it is going to fall off in 2011.
Though the judgment may fall off from your report, the judgment will not legally expire before the 10 years, that is before 2014. Thus, you need to pay off the judgment.
Thanks,
Aaron
Will filing for bankruptcy do anything to the default judgement?
reply
Hi,
If a motion to avoid lien was filed on the judgment, after the bankruptcy, then you can send that letter to the creditor requesting to vacate the judgment. However, if the motion to avoid lien was not filed, sometimes all liability on this debt gets erased. Sometimes, though you can be held responsible if the judgment was against your property.
Hope this helps.

Aaron
Credit Card judgement
I went through a divorce aprox 12 yrs ago. With all the "couch surfing" the immediately followed, a small bill from a credit card got, well, I dont know where " it got." Here in 2012, I get a phone call saying that there was a judgement filed Dec. 2005, and I now owe just shy of 7K and I need to make payment arrangements or they will "execute judgement." I have never heard from or seen any form of communication regarding this bill or debt/judgement. EVER. Do I have an alternative or do I start the payment process to avoid being attacked? I am a Washington State resident.
Thanks
Jerrod
