Hello!
I am new here, but have been looking on the forums a lot lately as I try to clean up my credit.
This morning I called AFNI collections, because there is a debt listed for 201 dollars, with the "account open" date as 12/2009. The woman told me that they purchased the debt from T-Mobile, for an account that I opened in 8/03 and defaulted on in 10/04. I did have a T-Mobile account that I probably defaulted on (I was young, irresponsible and had no idea of the repercussions).
My question is: How can this debt JUST NOW appear on my credit report? Does the clock restart in 2009, and so will remain until 2016? I asked if they would do a pay for deletion and she said that I was not eligible. I am really frustrated. I live in CA and any advice would be appreciated.
Here is california's information
Oral Contract: 2 years
Written Contract: 4 years
Promissory Note: 4 years
Open-Ended Accounts: 4 years
so this is 2010, you are well past the statute of limitations.
past the statute
Hi missramsey,
Welcome to this community :)
This debt may have past the Statute of Limitations (SOL). So, can you tell me the state you live in? The SOL varies according to state. Another thing that I would like to know is the date of last payment.
This is a clear case of reaging of debt, and reaging of debt is considered illegal. Only if the debtor requests the creditor or collection agency to change the date, can it be done. You can complain about this to the Federal Trade Commission.
Thanks,
Aaron
Hi Goodnatured and Aaron,
Thanks for your responses. I live in California and the account was either reported in 2004 as delinquent or sent to a collection agency. Not sure which one happened, but either way I have not made a payment since probably late 2003.
I am interested in this "reaging" debt, which I've never heard of before. I wonder what the next step for me is?
On a side note: I also just realized that there are two different listings on my credit report for the SAME account. One is from the actual company, the other from a CA. Again, both of these accounts are from 2002-2004. Also, on my TransUnion report, they are listed to "fall off" in like 2015...past the 7 year mark. These CA's seem so shifty and I never realized how much work was required on my end to make sure they aren't screwing me over.
