Debt not mine

Hi,

A cell company billed me for 3 months of service i didn't have,they sent me to collections and i told them i wasn't paying for service i didn't have. They reported negative on my credit report, and then they sold it off to two more collection agencies who also reported negative on my credit report, that too for the same bill. Is this legal? also i did try and take it up with sprint but they told me that since i canceled service there is nothing they can do the account is closed. I never ever opened an account with them :shock: so where from does the question of cancellation come in? :x

Can i get some thoughts on this?

Hi Aldis,

First send debt validation letter to the collection agency who now holds the account. As this debt wasn't incurred by you, they may not be able to validate this debt. Send the letter through certified mail, requesting a return receipt. Immediately after you get back the return receipt, send dispute letters to the credit bureaus. Now, the credit bureaus will notify the collection agency (CA) of this dispute. As a result the CA will have to verify this debt with the credit bureaus within 30 days.

However, before the CA can verify this debt, the CA will have to validate the debt with you. Now, if they fail to verify the debt with the credit bureaus within 30 days, the bureaus will delete this tradeline. Now, if they verify the debt with the credit bureaus, and do not mark the debt as in dispute then they are in violation. Thus, you can file complaint with the Fair Debt Collections Practices Act.

As for the legality of the debt reported more the once under different colelction agencies, I would say that this is legal. If the debt is sold off to a CA, and then this CA sells it to another CA, then the debt will be listed under both the CAs. However, your original creditor and the first CA will have to report 0 balance against this account.
