I've managed to get so much stuff deleted off my reports I'm down to only a few negatives and less than $700 in debt out of $25,000.
However, a CA is telling me they won't settle for anything less than the full amount and that they will not remove the negative listing from the CRAs even if I pay it in full. This charge is from 8/2007. It's $198, and I just want to have it gone all ready. I've disputed it, sent pay for deletes, disputed it again, everything but threatening to sue them. This is one hold out! They won't budge. I'm definitely at my wits end. I know that the SOL is almost up on it, just one more year, but I need it gone now. It's medical, and I've heard that sometimes if you go to the original creditor they can usually work out more beneficial terms....
any one have any luck with this?
What can I do with the CA not wanting to settle
Hi Krystal,
If the collection agency is not agreeing to the debt settlement offer, you can first make a copy of your monthly income and expenditure. Then, send another settlement letter, and attach a copy of your monthly income and expenditure. If they find that you won't be able to make the payments without the settlement, they may agree to the settlement offer.
However, as this is not a huge amount, you can try to pay it off without the settlement. Moreover, debt settlement lowers your credit score.
As for the original creditor, yes you can request him to pull back the account from the collection agency. If the debt hasn't been sold off, the creditor may agree to pull back the account. It is much easier to deal with a creditor than a collection agency.
Thanks,
Aaron
