Civil suit for false debt

I received a phone call yesterday from a collection agency, stating a civil suit is being brought against me for a debt. However, this debt isn't mine. The caller has information about me including my correct SS#. When I told the caller the debt isn't mine he offered to settle the debt for a smaller amount of money than he previously stated.

I asked him to mail any information he has. So, he again called me, and stated the creditor has been looking for me since for years. What should I do now? I'm planning to purchase a home early 2011 and I don't want a ding on my credit rating.

Hi Allen,

Send them a debt validation letter immediately. This will stop them from filing a lawsuit against you. No collection agency can continue with the collection process until they can validate your debt.

You will get a sample validation letter with this community, which you can use to write one of your own. Moreover, you should put a fraud alert on your account as the collection agency has your social security number.

they can't threatnen to sue unless they have the power and authority to do so and have done so in the past (can prove a past record of lawsuits). otherwise, it's an FDCPA violation.

have you pulled your credit to see if they have reported this already?
