I live in the state of florida and received papers today in the mail saying that a credit card company is asking for a judgement against me for a credit card. There is no signed contract for this card. What can they do to me? Everything I own is in mine and my husbands name even our bank account. It's been listed as a charge off as of july 2009. It is listed as only my name. I have no job. So what can they do?

Thanks, Debbie Miller

Hi Dhaws,

The credit card company can file a lawsuit against you for non-payment of dues. If they win, and receive a writ of judgment, it can be executed against all non-exempt property that belongs to the debtor. Even if the property is in both your and your husbands name, like bank accounts, they can take money from the accounts.

Thanks,

Aaron
