We went to court for this judgement and said we disputed it. The judge said thats fine just write the company and tell them why you disputed it. So we did and waited to here from them. When we finally heard something it was from the court house so my husband went up there and told him that we went home and wrote the company and sent it right away. He said we were suppose to send it to him, we were both there and both understood we were to send it to the plaintiff. So if we didn't understand than that was our fault and he granted them the judegement. It was for 11734.49 for a used car that we bought, paid on for a year and returned in the same condition. Then they said they only sold it 2000.00. The company we bought the car from was Drive Time and now its a different company. This is for a car we paid on for approximately a year. I was diagnosed with multiple sclerosis and I tried to keep working and I became very sick. So we called the car lot and said we couldn't afford the payments anymore. They said well bring it back and we will sell it. So thats what we done. This was in Texas. We then moved closer to home which is in Illinois so my family could help with the kids. Now I get s/s benefits and we received a letter from the court for a wage deduction. We still have two children at home and one grandchild. We don't feel we got a fair decision. should we file bankruptcy or hire a lawyer to fight this. My husband only works for a temporary agency and I collect s/s. We do have a house loan but we can't get out of it what we owe.

Can you tell whether or not you have any written proof that you disputed this judgment? If you couldn't make payments on the car, you could have talked to the lender for a repayment plan. This would have been of some help.

If you can afford to pay a lawyer to fight this case, you can take help from a lawyer. However, if you cannot afford to make any kind of payments, then you may file bankruptcy.
