Paycheck Garnishment

I need help asap and Im really praying that someone can give me some advice...

In February, I started doing credit repair on mine and my husbands credit reports and I sent a letter of validation to a collection agency here in my town. They haven't validated the debt at all and validated with the CRA and this past week they placed a garnishment on my husbands paycheck. Is this legal? What are my options? Heather

Hi willison_family,

Welcome to this community :)

Can you tell what do you mean by "validated with CRA"? As for the garnishment, the collection agency cannot continue with any kind of collection process if they are unable to validate your debt. Thus, they can't even garnish your account.

Can you tell whether or not you have proof of the validation letter sent to the collection agency? If you have, you can dismiss this judgment.

Thanks,

Aaron

Thank-you so much Aaron!
I sent a certified letter to the collection agency asking that they verify that the debts even belong to me. They got both certified letters but never responded back to me. They verified the debts with the credit reporting agencies though which I know is a violation.

Yesterday I filed a complaint with the FTC and the MT State Attorney Generals Office. I couldnt with the BBB because they dont have them listed.

Im going to go to Justice Court today and ask for proof that the writ of execution even exists. And if so I am going to provide them my documentation of the letters I sent them and receipt of certified.

I hope I am doing the right thing here.....

I have to say Im in love with this forum already....I was with another forum and nobody ever answered any questions.

Thank-you again so much for your help! I really appreciate it :0)

Many Blessings, Heather
