Received no response to debt validation ltr but being sued

Hi all,
I'm not certain how to handle this issue. I sent (via certified mail) a debt validation letter to Bureau Investment Partners (BIP) back in 2007 regarding a debt they were attempting to collect. BIP never responded to the letter. I didn't really think much about it after that. It was a bill that I had no knowledge of, and that had never (and still has not) showed up on my credit report.

Now however, I've recently received a summons regarding the same debt and original creditor. I realize that I need to respond, but I'm not exactly sure how to go about it. Isn't there any onus of responsibility on BIP to validate this debt? I'm in California and am trying to complete this process on my own. Would it be wiser to procure the services of a lawyer?

Any guidance on this will be greatly appreciated.

BIP cannot sue with out responding to the DV but this is the original creditor.

Basically this is a civil suit concerning a broken contract. As long as this dept is not currently listed on your credit report the FCRA and FDCPA do not apply.

you must attend court. I would try and contact the OC. Why didn't you pay this? was there a dispute? When was the last payment made on this debt?

Hi,

Unfortunately, Bureau Investment Partners is suing without responding to the debt validation - 3 years after my request for it. I don't recognize the debt at all, and I don't remember ever making payments to the original creditor that sold this debt to BIP. This is where a response to the debt validation letter would have been helpful. I want to ascertain whether this is truly my debt.

At this point my primary concern is the same as previously stated - I need to respond to the court in writing using a particular format. Any assistance in this area will be greatly appreciated. I am in California and currently searching the LA Superior Court for the correct template with which to reply.

Send evidence of your DV with your answer and show up to court.

Hi msmoxie,

Can you tell who sued you? Is it the original creditor or the collection agency?
