I got a credit card about 10 years ago. After a while I couldn't make payments. I am on disability now and want to pay it off. I was contacted by CSR and they wanted to settle. The problem is I gave her my account number to my bank account. I asked her to wait until the next month but she didn't want to wait. To keep her from messing up my account I closed it. I still want to pay off my debt but I can only afford so much a month. I live in Alabama and she said she could hold up to 30% of my check, also she threaten me with Federal charges.Can she do that? Whats the best way to pay this debt, because someone told me not to contact the original creditor because they will just say it's out of there hands. I want to clean my credit up, but I tried to get a credit report and it never came. I am still married so my name changed ,could that be why my credit report did'nt come. I need my credit report, but haven't had any luck. What can I do to get my credit back on track. What would be best for me. Consolidation, credit counseling? Help!

Well first your credit report goes by your ss number you should try freeannualcreditreport.com I think that's the right email. As far as the credit card goes how long ago has it been since you made a payment? You need to find this out. Then check to see what the SOL is in your state if it has past then do not pay them anything if you do it will start the SOL all over and you will have to pay it. As for her trying to take you to court to garnish your disability that is not possible. So first things first get a copy of your credit report and find out when you made that last payment. Let us know how it turned out.

SIA, I see why you may want to repay your debt but you are really putting yourself in danger doing so. If you have not made payments since the ten years then this debt should not even be on your credit report and there fore have NO effect on your score. Once you make a payment you will reset the SOL and then be able to be sued.
The collector is just trying to scare you into paying. Go to annualcredit report.com and pull your report. You can veiw it online. If that debt is still there you need to dispute it as obsolete. You will be able to remove it. Further more if they do take you to court they will not win because of the SOL expiring.
