Can a loan comapny send a person to your home to leave written communication notes on your door everyday in public view? My husband has a loan with a loan company for an SUV. He is currently out of work due to a move. We have defaulted one time and they repeatedly come to our home and leave notes on the door. I was only 2 mo. behind but have caught up the payments for him.I am a shut in and totally disabled and these people sent a large truck to my home and tried to reposs this suv with out any court papers. We currently have it in our garage and they threatened to break the locks and take it. They have sent letters to my sons home in NC yet we live in PA. They leave all kinds of notes on the door, and we are trying to sell our home but they are there everyday. Is this legal? I am still behind 2 payments and I only owe 1200... I have paid over 8000 to them so far. By the way, I am not a signer on this loan whatsoever, and my husband does not live with me. Can they legally do this? I dont answer the door anymore because I am afraid. What can I do? Ruthie

I'm not real sure what to tell you about them coming to your house everyday. But I guess if you are behind they have the right to repo the car. Now I'm not sure but you could get in trouble for keeping it from them. Have you tried talking to them to set up some kind of payment arrangement with them to catch up what you are behind? If not and you want to keep the car I would. If you can't afford it then let them come get it. You could also call and talk to an attorney and get his opinion on what you should do.
Ruthie, They can not harass you. If your husband does not live with you then I would call and inform them of this. The best way to handle it would be to come up with the payments or a repayment plan. Has your husband tried to speak with them? I would try to call. I do not know if they have to have court papers. Try calling our (i am in PA too ) atty general. I had to call him recently and he was very helpful and got me my answers with in hours.

This was a gift from my husband four yrs. ago. I had no idea that he was behind in his payments. He is only one payment behind, and I did make arrangements. They want the Quad and the money. They are telling me its a breach of his contract and they have the right to take it. This is a $9000 Quad 4X4 And he only owes then 1200. They took 2 payments from me and want more. Can they do this????? By the way they know that we are getting divorced. They say they want me to pay because I own the house. Ruthie
I have never heard of them wanting you to pay because you own the house. But yes I would me fighting them tooth and nail also if that is all that is owed on it. Is there any way you can get in touch with your husband? If so maybe both of you can come up with a way to pay them off. Even if was to split the balance and put it on a credit card until you get straightened out. And the next time they show up at your door call the police. They cannot be doing that as long as you are paying.

Thankyou. I just talked to my x and he is willing to pay for this quad. He is in Plains Pa with his daughter. He said he tried to refinance it and they are doing hard inquiry's to his cedit report every 2 weeks, and they have lowered his credit score from 675 to 565. Can they do this????? I was under the impression that they can only do this once every 30 days. Am I wrong??? Ruthie

I am glad to here that you husband is going to take care of this. I bet that was a relief to you. And I'm like you I don't think they can report but every 30 days. But I'm not sure who you would call to report them for doing this. I sure someone on here will be able to help you with that. Good luck it looks like things are looking up for you. Hang in there ok.

If this only takes $1200 to pay off and you have made recent payments then I would let it fall into court and explain to them that this company wants the money and the quad. If this companies presses you then contact your atty general. I would all the main person and get the total needed to pay it off and try to do that as soon as possible. If they will not except the payment then let them know your next step is to call the atty gen
