My husband and I were involved in an automobile accident. The judgement is against me. Can the plaintiff try to get the money from my husband? I heard NO. The order was placed on October 8th of this year and the plaintiff feels she has given me ample time to pay her even though we agreed I would pay when I got my taxes. She doesn't want payments either. She wants me to get a loan to pay her. Can she do anything towards my husband regarding this matter?

mimaeffie, I believe the best person to ask would be your attorney. But, I will tell you what I think. I'm not a professional though or a lawyer or anything like that. This is just what I think.

I think that they can go after your husband; as well especially if you file taxes jointly. I think this because I have heard of step-parents being responsible for dilenquent child support on their partners behalf. I'm not sure if it is the same, but I think they can go after your husband. I'm sure if I am wrong----people will say so. That's just my opinion.

Did you have insurance at the time of this accident? If so your insurance company should be helping you by providing a free atty. Sometimes when people sue the other sides atty also sends copies of demands to the person themselves and their insurance company. If this is the fact you once again need to call your agent or insurance company. If it isn't maybe you can explain a little more what exactly happened so that we may help you a little better. There is not enough information for us to completely understand what is going on.
