NCO put a "hard" inquiry on my credit report for a debt that 1) was not legally mine and, 2) was already paid.
NCO did a "hard" inquiry with TransUnion for a bill that had already been paid by my medical insurance carrier. NCO did the inquiry on the same day that they sent me a collection notice. I responded (within 5 days) that the debt was invalid and gave them the check number, check date and date the check was cashed. I also informed them that in the State of California that an insured individual's health care plan provider is legally responsible for paying both contracted and non-contracted emergency care providers for services rendered to their enrollees. (I had already confirmed with the emergency service provider that my account was paid in full).
When I called TransUnion, they denied that this inquiry was on my credit report. When I told them I had a copy of my CR, they said there was nothing they could do and I could file Fraud Alert.
Well there has been mistakes committed. You should have send debt validation letter in the first go. I am sure they would not have been able to validate the debt because they were paid in full.
You can of course go ahead and file a fraud alert.
In a sense, what is the fraud alert going to do for you? The inquiry would still be there, and the fraud alert will just make it look like someone has been using your identity. When really that's not the case.
There is a letter here that you might send to NCO to demand them to remove credit inquiries from your credit report.

I had a 'credit freeze' on my credit (lost some governement information, that had my SS# on it). I had a few inquiries during that time. Ihad forgotten about the 'freeze'. The people that I gave permission to see my Credit Report were not able to access it, because of the 'freeze'.
As far as I know amendments were made to the FDCPA wherein collection of debts were allowed during the 30 days of validation period unless the consumer has an active written dispute concerning the debt.
