how to fight collection companies

Okay, what you need to do is look up the SOL on the debts in your state. I posted a thread with a bit of a cheat sheet.

Next you send DV letters (You can also find a few I posted here) to the CAs that are not past the SOL. Send the letters via USPS cert mail. 30 days after you sent the first letter send a second letter.

Once you send the 2nd letter dispute the listings with the 3 CRAS.

If they come back verified through the CRAs start the MOV process (I posted that process too)

Now, 30 days after the 2nd letter has been sent you should have your MOV responces from the CRAs.

IF the CAs have not yet responded to your letters send the letter I posted to the CRAs along with your copies of the DV letters and cert mail reciepts.

Once the CRAs respond to those letters send a ITS letter to each CA and CRA that left negative info on your CR without verifying the debt.

I would send PFD to the compnys that did validate the debt in place of the ITS letters

The most important instrument for you in this case is the debt validation letter to the collection agencies which they must respond in order to claim money from you. Make all correspondence with the collection agencies in writing. Wait for 30 days for their response. If they cannot validate your debt, send a dispute letter to the CRAs telling them that you do not agree with the listing in the credit report.

If you do not find names of any collection agency in your credit report, you need not worry. All that you need to do is to find out or list the creditors whom you owe money and try to repay them. If you have some debts with any creditor, he or some CA to whom he sold off the debt, reports the debt to the CRA and this debt gets reflected in your credit report. Once it gets reflected in your credit report it will stay there for 7 years and lowers your credit score. So you need not search the collection agencies that are not listed in your report, but since you know the creditors from whom you had taken debt and to whom you have not repaid, try to repay them before it gets reflected in your credit report.

You can always send a DV letter to the law firm if it is acting as a collecting agency for your credit card company. If your debt has been sold off to the credit card company, they can validate your debt, else not. If they validate your debt, contact them for a repayment plan. If they cannot validate your debt within 30 days from the date of receipt of your DV letter, they cannot legally claim the debt from you.

I agree with Scott. If you send them a debt validation letter, the debt collector or the law firm as in your case, must cease all collection of the debt from you as per Section 809 of FDCPA till the time they obtain verification of the debt or any copy of a judgment. They need to validate your debt within 30 days from the receipt of your DV letter.

hey bubba22, how did you get things removed????? I have some old credit cards that I have paid off and they still are under negative activity because of bad payment history, they do reflect paid, but still in the negative, any advice would be greatly appreciated. thanks in advance.

GN you will have a REALLY hard time getting a paid account altered to your benefit since you have no leverage. You can try sending a goodwill letter. Your chances will be better if you still have an account with them either way it wont hurt you to send it.

As I'm reading posts this AM, I'm noticing a few DOUBLE-posts. The post from 'BESTBUYCREDITREPAIR' has been posted a few places.......same exact words. i'm not saying the person is not trying to help people, I'm just saying it doesn't seem 'real' if it's the SAME wprds used in the post.

I know. It is really aggravating. I am surprised a moderator hasn't caught this. Can you believe someone went to this effort to repeat their post? Must be cheaper than an ad in the local paper.

There are 'REAL' people, on this forum, who are willing to help people ( like me..LOL) When you see 'double posts', like the ones above, you wonder...is this person really willing to help others, or JUST themselves?

True there is so many out there, alot of them are fly by night sites that don't hang around long or have a hidden agenda to get money of a consumer in need.

Yep I was a busy little beaver last night. I kind of got screwed out of my job so now I find I have spare time to keep up with the forum posting.
