Daycare bill

Submitted by sdchargers_63 on Fri, 06/04/2010 - 18:59

(Hi everyone!! Haven't been on the Forum in a while. LOTS going on!!) To make a long story short, I'm suppose to register for classes, for Fall semester, at a local University. I found out I have an old daycare bill (11 years old) that is 'outstanding', at the University. It was in BOTH mine and ex husband's (huubby, at the time) name. Somehow it was transfered in JUST my name. My ex told me, some years ago, it was paid off...obviously not. It's not even on my credit. How can the University hold a bill, that old, aqainst me?

Hi sdchargers,

As far as I know, there must be a Statute of limitations (SOL) on this debt. You should just check the SOL in your state on such debt. It's been 11 years, and I think that the SOL must have expired.

Moreover, it's supposed to fall off after 7 years. So, you can dispute this item on this ground.

Thanks,

Aaron

Well.......thanks for the reply. The bill was never on my credit. The Billing Department, at the University, is saying,.."if the daycare was still in existence, then they COULD make some kind of arrangements with me." So..I'm not sure where to 'go from here'. They are not open, again, until Monday. Maybe I can make some 'progress' then.

Hi,

If it's not there on your credit report, then why are you worrying? I believe then this isn't hurting your credit, and thus, you need not worry.

Thanks,

Aaron

Well.........my concern was I couldn't register for classes until the bill was paid off. Also..I recently (in the last few days) DID look at my CR. The bill is NOW on there!! It wasn't when I first posted. I know the bill, itself is an 11 year old bill. However...on my CR it was reported RECENTY!! Geez..can't get a break!! Anyway..I made arrangements with the Billing Department (they wouldn't make any before). So...hopefully this will be cleared up soon.

Hi,

If you have already set up payment plan with them then it's well and good :) The problem will get solved.

All the best,

Aaron

yep...FINALLY I'm 'getting somewhere'. They said as soon as the bill gets paid off, they will take it off my credit, as well.

Yes..AARON...I sure did. The Fianancial Aid office sent me a letter, with all the arrangements that were made between the two of us. Really happy this was taken care of.

Many universities are a pain about being able to register while you still owe them for something, it can be difficult getting anything done, I am working my way through school right now and it is difficult to pay everything but I have to so I can register and get transcripts and everything else...you would think universities would be a little lenient but it can be just as difficult...

I am sure there is reason for this, probably had a bunch of young people not pay there bills.

Having students pay in advance is probably a way to keep past due bills from getting out of hand.

Well......I did work things out with the University..thank goodness! And you're right, CREDITSBADNOW,...that's what they told me, 'alot of (young) students are trying to get 'advances' , on things and not paying them back', etc. Or...haven't paid a bill since last semester..that kind of thing.

I am glad to hear that you got it all worked out, I am sorry that you are having to deal with all of this when you are trying to better yourself, sometimes what others have done in the past comes back to haunt everyone in the future.

Hopefully through this arrangement you will have a good relationship with the billing office anyway right, you at least know some of the people there through working through this, so if you have issues in the future you will at least be familiar with those that you have to deal with right? Something good has to come of it.

There is a statute of limitations on their ability to collect the debt after a certain number of years have passed since there was any activity on the account or as long as you did not reaffirm the debt. You should check if they can even collect on this debt.
