Lawsuit

I live in CA and have just been sued by Chase National for a CC debt. I am 72 and my only income is SS and a county retirement pension. I have 30 days to respond to the court or a judgement will be issued against me, I am a shutin in a power chair and I am trying to get legal aid to assist me, if not I will have to get an attorney to come to my apartment. My question is can a county retirement pension be garnished. I know my SS is protected. I also understand tht if a judgement is levied against me the bank can still freeze my bank account even thought it it protected and I will have to go through a process to get it released. As near as I can find out the bank will not disobey a court order and will still freeze the account if ordered. The bank is Wells Fargo. Any information would be greatly appreciated.

Hi,

As you have been asked to answer within 30 days, you need to answer. Else Chase National will win a default judgment against you. However, retirement income and social security cannot be garnished for credit card debt. Thus you need to mention in court that your only income is social security and retirement pension.

Hope this helps,

Regards,

Aaron
