I have several questions, I hope they can be anserwed. My husband and I filed for bankruptcy we were going for 7 but got 13. I had to quit my job because of babysitter issues. so that was a decrease in income by 600. we are on a 100% payment plan( we only filed bankruptcy because of garnishment) it says that we might have to give up our tax return of 5000.
and they can do so for the life of the plan which is 5 years so 5 times 5000 is 25,000 Are payment are set to be 20000 paid over the plan life which means we will be paying almost 50,000. i have a wonderful lawyer who does not return phone calls. I could take our tax return and pay off the garnishment and save almost 45,000 and not deal with this..ugg I need help.
so can I fire my lawyer for lack of communication?

Im also having trouble paying my bills plus the ch13 plan which the lawyer just put off

I believe you pay your lawyer. If the lawyer is not working, is not helping you in any way, then you can definitely fire him, if you want. If you are finding it increasingly difficult to pay the bills, you can go for debt settlement. Try to get into settlement agreements with the company. Debt settlement lowers the outstanding amount by 40-60%.
As for the bankruptcy, you can ask the court to dismiss it. If the court finds, that the dismissal won't hurt the creditor in any way, the court may issue a petition to dismiss the bankruptcy. It would be better to discuss this with a lawyer. As your lawyer is not helpful, you can go in for free consultation with an attorney.
